Key takeaway

Confirm that the judgment is effective and the obligation is due, calculate the application deadline, file with the appropriate court and provide useful asset leads. A favorable judgment or an existing freeze does not guarantee collection.

A favorable judgment is the start of a collection workstream

A foreign company wins a Chinese court judgment, but the debtor does not pay. The next task is not to argue the merits again. It is to establish an enforceable obligation, apply through the appropriate procedure, identify recoverable property and monitor the steps needed to turn that property into payment.

This guide concerns enforcement of an effective mainland Chinese court judgment. Recognition of a foreign judgment, a Hong Kong judgment or an arbitral award follows different rules and should not be treated as the same application.

There is no universal collection timeline. A debtor with accessible cash is different from one with disputed equipment, secured assets, competing creditors or no presently identifiable property. The plan should be based on that distinction rather than the size of the award alone.

Check effectiveness, performance dates and the application period

Obtain the complete judgment and confirm its legal effectiveness, including service and any appeal history. Distinguish the date printed on the decision from the date it became effective and the end of the period allowed for voluntary performance.

Civil Procedure Law Article 250 generally provides a two-year period for applying for enforcement, with statutory rules on the starting point, installment obligations, suspension and interruption. Article 235 identifies the basic jurisdictional route for enforcing civil judgments, including the first-instance court or a same-level court where the executable property is located. [1]

Do not calculate the deadline from memory or assume that negotiations make filing unnecessary. Record the relevant dates and obtain a case-specific calculation. An effective judgment can also contain obligations other than payment; the application must track what the operative provisions actually require.

Build an enforcement file, not another trial bundle

Prepare a concise application supported by the effective instrument, the information needed to identify the parties, appropriate authority documents, the unpaid-balance calculation and useful asset leads. Confirm the receiving court's current filing requirements.

Item Purpose
Judgment and effectiveness material Establish the enforceable obligation and its status
Performance and payment chronology Identify overdue obligations and payments already received
Calculation schedule Separate principal, awarded sums, costs and applicable delayed-performance amounts
Corporate and authority documents Confirm who applies and who is authorized to act
Debtor details Match the exact entity and registration data
Asset leads Give specific, supportable information for investigation or measures
Earlier preservation documents Identify existing freezes or seizures and relevant expiry dates

For a foreign creditor, address translations and the appropriate formalities for its identity and authorization documents. These depend on document type, origin and applicable arrangements; the foreign-company documents guide is a starting point, not a substitute for filing instructions.

Do not claim sums simply because they appeared in the original complaint. Reconcile the application with the judgment, subsequent receipts and any legally applicable delayed-performance amount. A transparent calculation is easier to check and update.

Give the court actionable asset leads

An assertion that the debtor is wealthy is less useful than a dated document linking the judgment debtor to an identifiable asset. Start with accounts used in the transaction, known premises, equipment, equity interests, vehicles and receivables supported by actual records.

The Civil Procedure Law provides reporting, inquiry and execution powers; those are powers of the court, not private authority for a creditor or its lawyer to obtain unrestricted bank information. Measures must be confined to legally executable property and the proper scope. [1]

Distinguish the debtor's assets from property of directors, affiliates, landlords, customers or subcontractors. Shared branding is not proof of common ownership. A claim to reach another person's assets or add another debtor requires its own legal basis and procedure.

For receivables, identify the alleged account debtor, the underlying contract and evidence that money is due. A disputed claim or a payment belonging to another entity is not equivalent to cash already available for collection.

Existing preservation does not guarantee priority or payment

Where an account or asset was preserved during litigation, keep a record of the measure, amount, location and expiry. Ask counsel to coordinate necessary continuation and the transition to enforcement. Do not assume that a freeze continues indefinitely without attention.

A frozen account may hold less than the claimed amount. An asset may be subject to a security interest, earlier measures, third-party rights or other claims. Being first to identify property should not be described as a universal entitlement to receive all sale proceeds ahead of everyone else.

The preservation guide explains the earlier stage. At enforcement, the additional questions are whether the asset can be realized, what rights attach to it and what net value is likely to remain.

Use settlement without abandoning enforceability prematurely

A debtor may offer installments once enforcement begins. Evaluate the proposed payer, security, initial payment and consequences of default. A promise is not the same as cleared funds.

Document which judgment obligation is being settled, how payments are allocated, whether any discount depends on full and timely performance, and what procedural step is being requested from the court. The Civil Procedure Law and the Supreme People's Court's enforcement-settlement rules govern available routes when an enforcement settlement is not performed. [1][3]

Do not sign a receipt stating that everything has been paid when only an installment arrived. Similarly, the decision to release a freeze should be linked to the agreement and risk assessment rather than treated as an administrative courtesy.

What a no-assets closure does and does not mean

Where the required investigation and other conditions are met, a court may terminate the current enforcement procedure, commonly called zhongben, because there is no presently executable property or identified property cannot currently be realized. This is distinct from payment in full or every form of final termination.

Under the Supreme People's Court's rules on this procedure, discovering executable property can support an application to resume enforcement; such resumption is not subject to the original application limitation period. The debtor's obligation does not disappear merely because the current procedure has ended. [2]

Obtain the ruling and review what was investigated, what remains unpaid and what leads were unresolved. Maintain a proportionate follow-up plan. Resumption is a procedural opportunity, not a guarantee that later assets will exist or be available ahead of other claims.

An illustrative scenario: a judgment against the wrong economic target

Illustrative scenario only; not a reported case or a client result. A creditor has a judgment against Company A. A factory using the same trade name is operated by Company B. Company A has little money, while Company B continues manufacturing.

The creditor cannot simply ask the enforcement officer to seize all of Company B's equipment. The factual relationship and any statutory basis for further proceedings or addition of a debtor need investigation. This explains why identifying contracting and payment entities matters before litigation, not just after judgment.

It also shows why an early debt-recovery assessment should consider collectability. Correctly proving liability against one company and actually reaching value in another are different problems.

Budget and reporting should follow recoverability

Agree on the scope of the enforcement engagement: filing, follow-up, asset investigation through lawful channels, objections, disposal issues and settlement work may require different resources. Clarify which expenses are included and which need approval. Do not assume that every expense will be shifted to the debtor.

A useful status report should identify measures taken, responses received, property found, obstacles, upcoming expiry dates and the next decision required. Distinguish work completed from money collected. This gives an overseas creditor a basis to decide whether further spend is justified.

For an initial enquiry, provide the court and case number, judgment date and status, unpaid amount, current enforcement status and a non-confidential description of known asset leads. Send the detailed file after conflicts and document-transfer arrangements are addressed.

Frequently asked questions

Will the court collect the money automatically after I win?

Do not rely on that assumption. Confirm the need for an enforcement application, effectiveness of the instrument and the applicable deadline, and take active responsibility for the filing plan.

Can I enforce a US or European judgment using this same checklist?

Not without a separate recognition-and-enforcement analysis. This article is about effective mainland Chinese court judgments, not foreign judgments or arbitral awards.

Does a no-assets ruling cancel the debt?

Termination of the current enforcement procedure is not payment in full. Review the precise ruling and the statutory resumption route when executable property is found. [2]
